Contest Rules

GENERAL CONTEST RULES  

 

These rules govern all contests conducted by KMHS Radio (KMHS), owned and operated by the Coos Bay Schools' Board of Directors, referred to as KMHS in this document. KMHS stations include KMHS-AM, K286CR-FM, KMHS-FM (individually or collectively referred to as the STATION(S) and any on the corresponding websites. 

 
  1. No purchase is necessary to enter any KMHS contest. 

  2. Contestants must be at least 14 years old to win unless otherwise specified.  

  3. Contests are open to legal residents who live in Coos County, Oregon. 

  4. Some KMHS contests will have specific rules. These rules will be aired and published on individual station websites during said contests. 

  5. Only one winner per household per 30 days is eligible for a contest. Any prize awarded to an ineligible listener will be deemed null and void, and an alternate eligible winner may be named. 

  6. Employees of KMHS, agents, successors, and assignees of its advertising agencies, and promotional companies, as well as family and household members of same, shall be ineligible to participate in the promotion. They shall be ineligible for any prize covered herein. 

  7. KMHS reserves the right to disqualify any winner if any contest rules are violated in any way. 

  8. The Contest and all the related pages and contents are copyright KMHS. Copying or unauthorized use of any copyrighted materials, trademarks, or any other intellectual property without the express written consent of its owner is strictly prohibited. 

  9. Anytime an entrant calls the Station, or uses website/social media pages to participate in a contest, you permit the Station to broadcast or record your call for a later rebroadcast.

  10.  As a winner of a KMHS contest, your voice, name, and picture may be used for promotional, broadcast, or Internet purposes.  Entrants further grant KMHS the right to use and publish their proper name online and in print or any other media connected with the Contest. 

  11. A merchandise prize is not redeemable in cash. No prize is transferable. Prizes will not be substituted or transferred at the winner's request. 

  12. KMHS reserves the right to substitute a prize of similar value. 

  13. Prizes are offered as is with no written or express warranty.  

  14. KMHS is not responsible for replacing tickets due to show cancellation, weather conditions, promoter, performer, travel arrangements, or events beyond the Station's control. 

  15. All winners of all contests are responsible for all taxes on the prize awarded. Any winner receiving a prize or multiple prizes valued over $600 must complete the appropriate tax forms at the KMHS studios before receiving the prize. All winners will be sent a 1099 MISC federal tax form if, in one calendar year, the prize value of all prizes won exceeds $600. 

  16. In the event the winner is subject to, or the subject of any order or legal proceeding by any governmental agency having jurisdiction over the affairs of the winner (i.e., garnishment, child support order, judgment, lien, and the like), KMHS may deliver the prize to the official representative of the governmental entity claiming a right to the prize shall be thus deemed as KMHS awarding the prize to the winner. KMHS shall be entitled to rely, in good faith, upon any documents presented by the representative seeking to collect the award instead of the winner. 

  17. KMHS shall not be liable for any claim by any winner for damages incidental to it. 

  18. Prize winners must possess a valid form of identification bearing the picture of the contestant acceptable to KMHS that will be presented to KMHS and accepted before the prize is awarded. 

  19. Winners will be expected to claim the prize at the KMHS studios (unless otherwise noted), 972 Ingersoll Ave. Coos Bay, OR. 97420 8:00 am – 4 pm, Monday through Friday (excluding holidays and school breaks) within two weeks of being notified that they are winners, unless there is an expiration date on the prize which will be expressly stated. 

  20. All Federal, State of Oregon, and local laws and regulations apply. 

  21. The contest is void where prohibited. 

  22. KMHS, their advertising agencies, affiliates, contest sponsors, employees, and immediate families shall be held harmless from any action or liability arising from any contest or prize awarded in any contest. 

  23. Winners may be required to sign a release form agreeing to release and hold harmless the Station or KMHS, its officers, directors, employees, sponsors, partners, agents, assigns, and affiliated companies. 

  24. As an FCC licensee and a trustee of the public airwaves, KMHS reserves the sole right to interrupt or discontinue any contest or promotion (and not award the offered prize) at the discretion of KMHS management if world events, the national mood, or public safety so warrant.  

  25. KMHS reserves the right to amend the rules to any contest at any time. 

  26. The judge’s decision is final. 

  27. For Contests that use phones for entry. 

a. The person operating the telephone at KMHS has full authority to decide on the winning caller.  

b. Contest phone lines are (541)267-1420.   

c. The phone number or lines may be changed without written notice due to technical or unforeseen difficulties. 

  1. KMHS shall have no responsibility for failure to win or claim any prize based on difficulties with telephone, facsimile, email, internet difficulties, or any circumstances in any contest. 

  2. Contests using online or written entry forms: 

a. All appropriate information in the required fields must be filled out, or you will be disqualified. 

b. To win a prize, you must reside within the listening area of KMHS, as defined at the exclusive discretion of KMHS management. 

c. Any problems with the Internet or email are not KMHS’s responsibility. 

  1. A copy of these rules is available during business hours at the KMHS office, 972 Ingersoll Ave., Coos Bay, OR.   

  2. KMHS may add additional rules that may differ from the General Contest Rules for a specific Contest or Promotion.  

  3. KMHS may change these General Contest Rules at any time without notice.
